Currently, The email validation is not possible in the way you explained above. But there is a workaround. You can use the MailChimp add-on ( https://www.wpdownloadmanager.com/download/mailchimp-subscription/ ) to push email address to a MailChimp list. Then activate the double opt-in. Now, the email address will be added to the list only after getting confirmation from the user. So, only real addresses are added to the list.

You don’t need custom fields to get user agreement. The “Terms and Conditions” lock does exactly what you want. Enable the lock from Package Settings Lock Options To know who accepted the terms enable the email lock too. You can see all collected email addresses from Downloads Subscribers page.
